After a year-long legal fight, Bungie finally agreed to settle the copyright lawsuit that was filed against them by writer Matthew Martineau back in October 2024.
The lawsuit revolves around Destiny 2’s Red War campaign, specifically the Red Legion faction, to which Martineau claimed contains materials that were copied straight from his works back in 2013-2014.
According to Martineau, Destiny 2’s Red Legion Cabal bears a striking similarity to the Red Faction legion in his works. Apart from that, he also alleged that a lot of the characters and concepts in his works were copied by Bungie.
For example, Destiny 2’s Dominus Ghaul and The Almighty were taken from Yinnerah and the Atonizer weapon in Martinueau’s works.

Back in December 2024, Bungie filed a motion for dismissal, citing that the claims are baseless and there is no proof to substantiate Martineau’s claims.
Surprisingly, however, the case actually managed to survive Bungie’s attempt to dismiss the case as the motion was rejected by the court back in May 2025.
Martineau even expanded the lawsuit and claimed that Destiny 2’s Curse of Osiris expansion also copied some of his works beyond the Red War storyline. He alleged that the expansion copied some of the narrative design, dialogue, and characters of his own work.

The case went on for more than a year, until a settlement conference held on November 12, 2025 revealed that the Bungie and Martineau agreed to settle the case, according to The Game Post.
According to the filing, “Negotiations were successful and resulted in the settlement of all claims. The Court thanks counsel and the parties for their efforts in bringing this matter to an amicable resolution.”
Then, on November 14, a new court filing was issued, revealing that the settlement is finally official. According to Judge Susie Morgan, “all parties have firmly agreed upon a compromise.”

As such, the lawsuit is now dismissed without costs. However, Judge Morgan stated that the case will be reopened in the event that the settlement does not follow through within a 60-day window.
Unfortunately, there are no details depicting the actual terms for the settlement. The court filing didn’t mention any amount or what other conditions were included in the settlement.
It’s worth noting that this isn’t the only lawsuit Bungie is facing. In fact, the company is currently facing an active lawsuit involving ex-Bungie director Christopher Barret, who is suing Bungie for wrongful dismissal.

Barrett alleges that Bungie fired him to avoid paying him an estimated $45 million in contractual payments.
However, some reports suggested that Barrett’s wrongful termination was due to complaints from female employees regarding inappropriate behavior.
As of now, there are no further details regarding this current lawsuit.
